1. Applicability

These terms apply to every bike rental by Kobra Bikes. By booking and agreeing, you accept these terms. Dutch law applies to the agreement.

2. Cancellation & right of withdrawal

Standard free cancellation within 24 hours of booking AND at least 7 days before the pickup date. With Flex cancellation, free up to 24 hours before pickup. A bike rental for a fixed date is a leisure service (art. 6:230p(e) Dutch Civil Code) with no statutory 14-day withdrawal right; the booking is immediately binding.

3. Age, renter & rider

The renter/booker is at least 18 and acts as guarantor. The rider is at least 14. An adult renter may let the bike be used by a rider named in advance (e.g. a child on holiday); the renter remains fully liable.

4. Identification & security

At pickup you show valid ID (passport, ID card or driving licence); the name must match the booking or the named rider. The ID is not retained. As security, Kobra Bikes asks for either a credit-card pre-authorisation or a redacted ID copy (citizen number and photo masked), deleted within 30 days of return.

5. Deposit & excess

No mandatory deposit at online booking. Excess for damage: up to €1,000 without insurance (set via a damage report), €0 with the optional insurance. For theft: €1,500 without insurance, €250 with the optional insurance. Kobra Bikes may request a deposit or credit-card pre-authorisation at pickup, released after correct return.

6. Optional bike insurance

Covers damage to and theft of the rented bike, with the excess above. Excluded: intent, riding under the influence, cosmetic damage and consequential loss, among others. The insurance covers only the bike, not third-party damage.

7. Renter obligations

Always lock the bike with the ART-2 lock and return all keys. Do not ride under the influence, do not tune assistance above 25 km/h, and do not disable the GPS tracker. On multi-day rentals, take the battery indoors at night. Report theft to police within 7 days. Non-compliance may void insurance cover.

8. GPS tracking

The bikes carry a GPS tracker (It's My Bike / IoT Venture GmbH) for theft prevention. By booking you consent to location tracking during the rental period (art. 6(1)(b) GDPR; processed on EU servers).

9. EU street-legal & liability

The bikes are EU street-legal (up to 25 km/h). Your personal liability (WA) insurance applies to third-party damage. Damage caused by negligence, an accident, a flat tyre or by third parties is at the renter's expense; damage caused by a third party is recovered by the renter directly from that third party. Kobra Bikes' liability is limited to the rental value of the booking. Late return is charged at €25 per hour, up to €100 per day, from the agreed pickup time (or the delivery time if delivered).

10. Governing law

Dutch law. Disputes are submitted to the Noord-Holland District Court, Haarlem location.
